Welcome to our application ShopsAroundYou App  This App is published by or on behalf of Ameriya Marketing Network (P) Ltd . “Ameriya Marketing Network (P) Ltd” or “ShopsAroundYou” is hereby called as “ShopsAroundYou” is a company registered in Tamil Nadu, India whose registered office is at I Floor, No 25  Parupukara Street Palakarai Trichy, Tamilnadu, India 620001.

This document is published in terms of the Information Technology Act,2000 and  in accordance and the provision of Rule 3 of the Information Technology (Intermediaries, guidelines) Rules,2011

2. Services Offered

ShopsAroundYou which is ShopsAroundYou is an App for a Directory of stores, shops, workplaces, and business establishments and a service provider on online that enables the registered stores, shops, and business establishments to connect with each other to build, develop and grow their business. And also serves as a directory for the users about all registered business establishments of stores or shops in this app.

ShopsAroundYou aims at providing an online platform to the “User” to globalize their stores, shops, or any other business establishments free of cost and also provide to exhibit their products to the world through this app with no cost.

3. General Rules Relating to Conduct.

By Install, downloading, or otherwise accessing the App or any part of it or utilizing the services such person is called a “ User” which includes without limitation users who have  Stores, Shops, business establishments, Browsers, Suppliers, Resellers, Other Purchasers,  Merchants or contributors of content and otherwise using the app.

The services of the ShopsAroundYou shall be availed by the User(s) who are eligible to contract under the Indian Contract Act 1872 and are at least eighteen(18) years of age.  The User agrees to be bound by the following terms and conditions. (“Terms”) and our privacy policy and our cookies policy. If the User does not agree with these Terms, they should stop using the App immediately.

The User is required to give a valid Phone number, an accurate current, and complete other required information. If  ShopsAroundYou sends any notification or an  SMS if the User does not receive it due to an incorrect phone number, out of data, blocked by the service provider, or the User otherwise unable to receive the SMS it is deemed to be provided the communication to the Users by ShopsAroundYou effectively.

4. Termination of Service

ShopsAroundYou has sole and absolute discretion and reserves the right to terminate, suspend or cease providing any services relating to the apps published by it, with or without notice, if it is brought to the notice of ShopsAroundYou or if it is discovered that the Users have breached, infringed, violated, abused, or manipulated, exploited, have acted unethically or do not meet the condition herein and ShopsAroundYou shall have no liability or responsibility to the User in any manner whatsoever if it chooses to do so. As long as this app and the information and services on the app are provided free of charge, ShopsAroundYou  will not be liable for any loss or damage of any nature.

5. Disclaimer of Warranties and Liability 

The ShopsAroundYou App is not a marketplace for selling and buying anything.   It is a Directory having details of Stores, Shops, workplaces, and other business establishments, registered in this app. The Users show their business place or places and their business activities to the other Users.

The registered Users are allowed to expose their products in accordance with the provisions of ShopsAroundYou terms and conditions They can display their products to the browsers and other users free of cost. It is a free service provided by ShopsAroundYou for the benefit of the Users for the development of their business.

Since ShopsAroundYou provide to display their product free of cost all commercial or contractual terms of sale are an agreement between sellers and buyers alone which dealing is outside the purview of the ShopsAroundYou   Buying and Selling their Goods and Commodities are users’ and browsers’ own risk. In no way does ShopsAroundYou involve itself in the offering or acceptance of such commercial or contractual terms between sellers and buyers. ShopsAroundYou never provide any payment and settlement of payment mode. ShopsAroundYou will not take any liability or responsibility for any loss or damages of any nature. It is strongly stated that ShopsAroundYou is only a facilitator and cannot be a party to any manner any transaction on ShopsAroundYou.

6. Governing Law

ShopsAroundYou must not be used for any illegal or unauthorized purpose. When you use the App you must comply with all applicable Indian laws and with any applicable international laws, including the local laws in your state of residence (together referred to as “Applicable Laws”).

7. Users Liability

Users agree that when using the App you will comply with all Applicable Laws and these Terms. In particular, but without limitation, the User agrees not to:

1. a) Use the App in any unlawful manner or in a manner that promotes or encourages illegal activity including (without limitation) copyright infringement or
2. b) Attempt to gain unauthorized access to the App or any networks, servers, or computer systems connected to the App or 
3. c) Modify, adapt, translate or reverse engineer any part of the App or reformat or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or by law.

Users agree to indemnify ShopsAroundYou  and any of its customer companies or its user in full and on demand from and against any loss, damage, costs, or expenses which they suffer or incur directly or indirectly as a result of User use of the App otherwise than in accordance with these Terms or Applicable Laws. 

8. Copyright and Trademark

ShopsAroundYou reserves the right to use or reproduce any content uploaded by the User. The User agrees to grant royalty-free worldwide rights to use or reproduce the content unconditionally, irrevocably, and perpetually for reasonable business purposes to ShopsAroundYou.

ShopsAroundYou and its partner companies owned the copyright in all material contained on, in, or available through the App including all information, images, illustrations data, text, audio clips, and video clips. music, sound photographs, graphics messages, and intellectual property rights, the selection and arrangement thereof, and all source code, software compilations, and other material (“Material”).

All rights are reserved. Users can view, print, or download extracts of the Material for their own personal and non-commercial use but Users cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, or disseminate in any form whatsoever or use the Material without ShopsAroundYou’ express permission. 

The trademarks service marks and logos (“Trademarks”) contained on or in the App are owned by ShopsAroundYou  or third-party partners of ShopsAroundYou. Users cannot use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of ShopsAroundYou or the relevant third party partner of ShopsAroundYou.

Unless otherwise stated, ShopsAroundYou and/or its licensors own the intellectual property rights for all material on ShopsAroundYou. All intellectual property rights are reserved. Users may access this from ShopsAroundYou for User’s own personal, noncommercial use subject to restrictions set out by ShopsAroundYou.

9. Content Liability

ShopsAroundYou shall not be held responsible for any content that appears on the User App. User agrees to protect and defend ShopsAroundYou against all claims that are rising on the  App. No link(s) should appear on any Website that may be interpreted as libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

10. Link to Third Parties

ShopsAroundYou may provide Users with access to websites operated by third parties (“Third Party Websites”) over this app. Notwithstanding such affiliate programs, ShopsAroundYou does not have any influence, control, or input over any such Third Party Websites.
It is entirely the User’s own risk and discretion to use the application and, unless otherwise stated, ShopsAroundYou is not responsible for and does not endorse any Third Party Websites or their availability or contents.ShopsAroundYou has no liability whatsoever arising from or relating to the User’s use of third parties websites.

Parts of this app offer an opportunity for Users to post and exchange opinions and information in certain areas of the App. ShopsAroundYou does not filter, edit, publish or review Comments prior to their presence on the App.

Comments do not reflect the views and opinions of ShopsAroundYou, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, ShopsAroundYou shall not be liable for the Comments or for any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this App.

11. ShopsAroundYou Privacy Policy

ShopsAroundYou takes User privacy very seriously. ShopsAroundYou will only use the User’s personal information in accordance with the terms of the ShopsAroundYou privacy policy and cookies policy. By using the App User acknowledges and agrees that the User has read and accepted the terms of the ShopsAroundYou privacy policy and cookies policy and these Terms. Please read Privacy Policy.

12. Disclaimer / Liability 

Use of the app is at Users own risk. The app is provided on an “as is” basis. To the maximum extent permitted by law:

1. a) ShopsAroundYou disclaims all liability whatsoever, whether arising in contract, tort (including negligence), or otherwise in relation to the app. And
2. b) All implied warranties, terms, and conditions relating to the app (whether implied by statute, common law, or otherwise), including (without limitation) any warranty, term, or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose, availability, non-infringement, information accuracy, interoperability, quiet enjoyment, and title are, as between ShopsAroundYou and User, hereby excluded.

In particular, but without prejudice to the foregoing, ShopsAroundYou accept no responsibility for any technical failure of the internet and/or the app or any damage or injury to Users or their equipment as a result of or relating to their use of the app. The user’s statutory rights are not affected.

ShopsAroundYou will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with the App, for any:

1. economic loss (including, without limitation, loss of revenues, profits, contracts, business, or anticipated savings); or
2. loss of goodwill or reputation or

III. special or indirect or consequential loss.

To the maximum extent permitted by applicable law, ShopsAroundYou excludes all representations, warranties, and conditions relating to this App and the use of this website. Nothing in this disclaimer will:

1. a) limit or exclude ShopsAroundYou or the User’s liability for death or personal injury.
2. b) limit or exclude  ShopsAroundYou or the User’s liability for fraud or fraudulent misrepresentation.
3. c) limit any of  ShopsAroundYou or User’s liabilities in any way that is not permitted under applicable law or,
4. d) exclude any of ShopsAroundYou or User’s liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability are set in this Section and elsewhere in this disclaimer:

1. are subject to the preceding paragraph, and
2. govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort, and for breach of statutory duty.

Nothing in these Terms shall be construed as excluding or limiting the liability of ShopsAroundYou or its group companies for death or personal injury caused by its negligence or for any other liability which cannot be excluded by Indian Law.

13. Advertisers in the App

We accept no responsibility for adverts contained within the App. If the User agrees to purchase goods and/or services from any third party that advertises in the App, the User does so at the User’s own risk. The advertiser, not ShopsAroundYou, is responsible for such goods and/or services and if the User has any queries or complaints in relation to them, User’s only recourse is against the advertiser.

14. General

These Terms (as amended from time to time) constitute the entire agreement between User and concerning User’s use of the App. ShopsAroundYou reserves the right to update these Terms from time to time. If it does so, the updated version will be effective immediately, and the current Terms are available through a link in the App to this page.

Users are responsible for regularly reviewing these Terms so that Users are aware of any changes to them and Users will be bound by the new policy upon the User continued use of the App. No other variation to these Terms shall be effective unless in writing and signed by an authorized representative on behalf of ShopsAroundYou. These Terms shall be governed by and construed in accordance with Indian law and the User agrees to submit to the exclusive jurisdiction of the Indian Courts.

 If any provision(s) of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties (as reflected in the provision(s)) and all other provisions shall remain in full force and effect

ShopsAround you’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by ShopsAroundYou in writing ShopsAroundYou.
